Agreement

These Terms & Conditions apply to your use of floridapetfarewells.com (the "Site"), operated by QSR Florida LLC, doing business as Florida Pet Farewells ("Florida Pet Farewells", "we", "us"). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.

For information only

The Site is a free online directory of independent pet cremation, burial, aquamation and memorial providers in Florida. Everything on the Site is general information provided for convenience only. It is not professional, veterinary, legal, financial or grief-counseling advice.

We do not provide, endorse or guarantee any listed business

The providers listed on the Site are independent third parties. They are not our employees, agents or partners, and we do not own, operate, control, inspect, license or supervise them. A listing or label is not an endorsement, recommendation, certification or guarantee of quality, licensing, insurance, pricing, availability, or how a provider handles, cremates, buries or returns remains. Many listings were compiled from public sources and may be incomplete, outdated or wrong. Always confirm details directly with the provider before you arrange care or pay.

We are not part of your dealings with any business

Any arrangement, purchase, service, cremation, burial, memorial or other agreement you make with a listed provider is solely between you and that provider. We are not a party to it and are not responsible for it, including for payments, refunds, cancellations, the handling or return of remains, losses or disputes.

Your choices

You alone decide which provider to use and what services to arrange. Ask each provider how your pet will be cared for, whether cremation is individual or communal, whether and when remains will be returned, and the full cost, and get the details in writing. Your veterinarian may also be able to help.

Images

Scenic images on the Site are illustrative settings, not photographs of the listed businesses, unless a listing says the photos were provided by the business.

No warranties

The Site and all content are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of accuracy, completeness, reliability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of viruses.

Limitation of liability

To the fullest extent permitted by law, QSR Florida LLC, Florida Pet Farewells, and their members, managers, owners, employees and affiliates will not be liable for any direct, indirect, incidental, special, consequential or punitive damages, or for any emotional distress, property damage, or loss of money, data or use, arising out of or related to the Site, its content, or any listed business or its goods, services, activities, acts or omissions, even if we were told such damages were possible. If we are found liable despite these Terms, our total liability for all claims will not exceed one hundred U.S. dollars (US$100).

Release

To the fullest extent permitted by law, you release us from all claims, demands and damages of every kind, known and unknown, arising out of or connected with any dispute between you and a listed business or any other user.

Indemnity

You agree to defend, indemnify and hold harmless QSR Florida LLC, Florida Pet Farewells, and their members, managers, owners and employees from any claims, losses, liabilities and expenses (including reasonable attorneys' fees) arising from your use of the Site, your dealings with any listed business, or your breach of these Terms.

Links to other websites

The Site links to websites and services run by others. We do not control them and are not responsible for their content, prices, privacy practices or actions. Using them is at your own risk and under their own terms.

Business listings and content you send us

If you own or represent a listed business, you can ask us to correct or remove your listing at any time by emailing hello@floridapetfarewells.com. When you send us text, photos, logos or other material for your listing, you confirm that you own it or have permission to use it, that it is accurate and lawful, and you give us a free, non-exclusive, worldwide license to use, copy, resize, edit for length and display it on the Site and in our promotion of the Site, until you ask us to remove it. We may edit, refuse or remove any listing or content at our discretion.

Names and trademarks

Business names, logos and trademarks belong to their owners and are used only to identify the listed businesses. Their appearance on the Site does not mean they are affiliated with or endorse Florida Pet Farewells.

Acceptable use

Do not misuse the Site, including copying it in bulk, scraping it, sending spam or false information through it, or interfering with its operation.

Changes

We may update the Site, its listings and these Terms at any time. The date at the top shows when these Terms were last changed. Continuing to use the Site means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be brought only in the state or federal courts located in Lake County, Florida, and you consent to their jurisdiction. If any part of these Terms is found unenforceable, the rest stays in effect.
